TERMS & CONDITIONS

Please read these terms and conditions carefully as they outline the rules and regulations governing your enrolment with Swim Zone. By being enrolled with Swim Zone, you automatically agree to abide by these terms and conditions.

FEES & PAYMENTS 

1.1

An annual registration fee of R250 is payable per swimmer every year. For example, if you join us in April 2025, you will pay the annual registration fee of R250, which will then only be applicable again in April 2026.

1.2

Fees are due in advance and must be paid in full within 2 weeks from invoice received. NOTE- It is implied that when you join you will receive an invoice for the service you are receiving. If you do not receive your invoice within one week of starting- contact the admin department and notify them hereof. We will not know if you do not receive the invoice. it is therefore important to notify us so that we can assist and not halt lessons

1.3

Swimmers with outstanding fees- lessons will be halted after the initial 2 weeks if fees are not settled. There will be no make-up lessons. If lessons are halted due to outstanding fees, the lessons are forfeited and lost.

1.4

We are a CASHLESS facility; however, we do have card payment facilities available at the following venues: Woodhill, Sunbird, Pinnacle, Reddford and Grootfontein.

1.5

Accounts that are in arrears for a full Term will be handed over to dept collectors.

1.6

Invoices will indicate the amount + VAT.

1.7

The Company reserves the right to increase fees annually.

CANCELLATION POLICY

2.1

One month’s written notice via email to your coach and the company’s administrator (admin@swimstation.co.za) notifying them that you do not wish to proceed with lessons in the following term is the only valid process to follow

2.2

Whatsapp and Verbal communication of your cancellation is not accepted.

2.3

 

Not attending any lessons DOES NOT qualify as cancellation and full fees are applicable.

2.4

In the event of chronic illness and/or injury an arrangement can be made to accommodate the situation with written notice given via email as indicated in 2.1.

LESSON CANCELLATIONS & MAKE - UPS:

2.5.1

If a lesson is cancelled due to school clashes/ sick coaches/ damage or maintenance to the pool or facility etc, the company will make the lesson up where applicable.

2.5.2

If lessons are missed on the client side due to other sport clashes/ illness/ forgetting etc,   the lesson will be forfeited. You are welcome to ask your coach if they have a gap to see if they can accommodate on account of a lesson being missed. But you will then need to fit into what they have available and the pairing would need to be applicable to the coach.

2.5.3

Lessons lost due to lightning are also not made up, lessons will commence if the ambient temperatures are comfortable- even if it’s raining. We will however cancel lessons whenever there is lightening within a 15-20km radius. The distance will be to the coach’s discretion and under absolutely no circumstances can this be waivered by external opinion (INDOOR and OUTDOOR). If we see that 3 sessions for example have been lost due to lightening on the same days (Example- 3 Thursdays in a row get cancelled due to lightening), we will try and accommodate with an additional lesson, if possible,

ADDITIONAL RULES & REGULATIONS

3.1

Please arrive promptly for the allocated swimmer's lesson time, as we operate on a set timetable. If a swimmer cannot attend a lesson, please notify your coach in advance. Lessons cannot be extended. If you arrive late for your lesson- the swimmer will only receive a lesson for the time remaining.

3.2

We reserve the right to stop a child’s swimming lesson if his/her behaviour is untoward, unruly and/or affects the lesson negatively and has the potential to put other swimmers at risk.

3.3

All correspondence/booking will be done via email. Please ensure that we have your correct contact details for important information

3.4

The owners and employees of the Company, located at Our POOL VENUES, will not be held responsible for any loss, damage, theft, injuries, or death

3.5

Smoking is prohibited at ALL pool venues of operation. No glass or dangerous objects are allowed in the pool areas.

3.6

Swimming caps are compulsory for all swimmers regardless of gender or age. No board shorts, bikinis or clothes will be allowed. If this dress code is not adhered to and the swimmer is disallowed from partaking in the lesson, the swimmer will nevertheless remain liable for the full cost of that lesson

3.7

If you will be collecting your child after their swimming lesson please be promptly on time as we cannot be responsible for them as all coaches will be in the pool coaching and will need to place full attention on the children in the water

3.8

In the event of an individual that is not you as the swimmers’ parent collecting your child from their swimming lesson for example family members, au pair, transport service etc, we require a written notice of this arrangement along with the responsible person collecting your child, a copy of their ID and Valid Driver’s Licence.

3.9

No swimming on public holidays

3.10

Transport/ Shuttle services will be available at certain venues- If you decide to utilize this service, all necessary disclaimers, permissions (in writing) and liabilities will have to be signed and before any swimmer may get on the bus. This will be a separate set of paperwork and arrangements

A comprehensive Indemnity / Waiver of Liability is attached hereto and by signing here the swimmer and his parents/ guardian (as recorded above) acknowledge, accept, agree to and are bound by the contents thereof.

INDEMNITY FORM

WAIVER OF LIABILITY

General release of Liability, Waiver of Claims and Indemnity Agreement

1.1

Before completing / signing this agreement, take time to consider the contents and make sure you understand all the information being asked of you and being provided to you.

1.2

This is a legal document and you will be expected to take the time to read it and consider it before completing it and signing it.

1.3

Any one participating in any activity offered by the company must complete and sign this agreement and appreciate that once you sign this agreement it will be accepted that you have read the entire agreement and have accepted all the risks associated with participating in any activity offered by the company, any also all risks associated with utilising the premises / facilities upon which the company operates.

1.4

Once you have signed this document, you agree that you will be waiving certain of your and/or the swimmer’s legal rights, including the right to pursue any form of legal action against the company for any injuries and/or damages you and/or the swimmer may suffer whilst participating in any activity offered by the company, any also all risks associated with utilising the premises / facilities upon which the company operates.

1.5

Please note that:

1.5.1

all references to the company include, but are not limited to, its owners, directors,

officers, employees, contractors, sub-contractors, agents, instructors / coaches, representatives,

managers and the like;

1.5.2

all references to personal injury include, but are not limited to, any prejudice, loss, damage, illness, or

injury;

1.5.3

all reference to property damage includes, but is not limited to, theft.

Acknowledgement and assumption of risk

I and/or the swimmer, acknowledge that I/we accept all risks associated with:

2.1

participating in any swimming training, gala or related activity offered to me/ the swimmer by the company;

2.2

utilising the facilities, including but not limited to the swimming pool and its surrounding areas and the rest/change rooms, at whichever institution or swimming arena the company is operating from.

Release of Liability, Waiver of Claims and Indemnity Agreement

 

I hereby agree as follows:

3.1

to waive any and all claims that I or the swimmer have or may in the future have against the company due to but not limited to any negligent and/or wilful and/or deliberate act by the company, and to release the company from any and all liability for any property damage or personal injury to myself, the swimmer or any property damage or personal injury caused to any third party or by any third party resulting from my or the swimmer’s participation in any activity offered by the company, also any and all risks associated with utilising the premises / facilities upon which the company operates; and

3.2

to waive my right to recover any costs resulting from any damage caused to my and/or the swimmer’s property and/or personal injury caused, loss and/or medical conditions resulting in any form of hospitalisation, the need for medical treatment whether initially or long-term;

3.3

that this agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death; and

3.4

that this agreement shall be governed by and interpreted in accordance with the laws of South Africa;

3.5

that by entering into this agreement I am not relying on any oral or written representations or statements made by the company with respect to the safety of participating in any activity offered by the company, any also all risks associated with utilising the premises / facilities upon which the company operates / utilises, other than what is set forth in this agreement.

4

Confirmation

4.1

I confirm that I have read and understood the terms of this agreement prior to signing it, and that I am aware that by signing this agreement I am waiving certain legal rights which I or my heirs, executors, administrators, assigns or representatives may have against the company.

4.2

I confirm that I have read and understand the terms and conditions contained in this agreement and agree to all terms and conditions therein.

4.3

I confirm that this waiver is unconditional.

4.4

I confirm that I, where the swimmer is younger than 18 years of age, am duly authorised as the parent and/or legal guardian of the swimmer to sign this agreement in my personal and representative capacity.
